  • Payment information (processed securely through third-party providers)
  • Professional credentials and certifications

When you access our services, we automatically collect certain information:

Information Collected During AI-Powered Calls

When you interact with our AI-powered phone system, we may collect:

  • Information you provide during the call (e.g., scheduling preferences, service requests)
  • Consent and opt-out requests made during calls

How We Use Your Information

We use the collected information to:

  • Provide, maintain, and improve our services
  • Process photographer applications and certifications
  • Match photographers with job opportunities
  • Process payments and manage accounts
  • Send administrative communications
  • Provide customer support, including via AI-powered phone calls
  • Send marketing communications (with your consent)
  • Make AI-powered and automated outbound calls for appointment confirmations, scheduling, reminders, and follow-ups (with your Prior Express Written Consent)
  • Analyze usage patterns to improve our platform
  • Improve the quality and accuracy of our AI communication systems
  • Protect against fraud and unauthorized access
  • Comply with legal obligations

AI-Powered Communications

How We Use Your Phone Number

If you provide Prior Express Written Consent during registration or through your account settings, we may use your phone number to contact you via AI-powered and automated outbound calls. Your phone number will only be used for AI-powered outbound calls if you have provided explicit, voluntary consent. See our Terms of Service, Section 6 for full details on AI-powered call consent.

Consent Records We Store

To comply with the Telephone Consumer Protection Act (TCPA), FCC regulations, and applicable state laws, we maintain detailed records of your communication consent, including:

  • Timestamp: The exact date and time (UTC) you granted or revoked consent
  • Method: How consent was provided (e.g., web registration form checkbox, account settings toggle, written agreement)
  • Phone Number: The specific telephone number for which consent was granted
  • Consent Language: A copy of the exact disclosure text presented to you at the time of consent
  • Technical Data: IP address, user agent, and session information at the time consent was recorded
  • Revocation Records: If consent is revoked, the date, time, and method of revocation

Consent records are retained for a minimum of five (5) years from the date of consent or revocation, whichever is later. This retention period exceeds the applicable statute of limitations to ensure compliance.

Call Recordings and Transcripts

AI-powered calls may be recorded and transcribed. These recordings and transcripts are used for:

  • Quality assurance and service improvement
  • AI system training and accuracy improvement
  • Compliance verification and audit purposes
  • Dispute resolution

Call recordings are retained for twelve (12) months unless a longer retention period is required for legal or compliance purposes. You may request deletion of your call recordings by contacting us at privacy@lenslooper.com.

Opting Out of AI Communications

You may revoke your consent to AI-powered and automated calls at any time through any of the following methods, free of charge:

  • Update your preferences in your account settings
  • Call us at (925) 575-8513
  • Email support@lenslooper.com with subject "Opt Out AI Calls"
  • Say "stop calling," "remove me," or "opt out" during any AI-powered call

Opt-out requests are processed within two (2) business days. Opting out will not affect your account or access to services. We honor the National Do Not Call Registry and all applicable state Do Not Call lists.

Information Sharing

We may share your information in the following circumstances:

With Service Providers

We share information with third-party vendors who perform services on our behalf, such as payment processing, email delivery, hosting, AI and telephony services, and analytics. Our AI telephony service providers are contractually bound to use your data only for the purposes of providing services to LensLooper and are subject to appropriate data protection obligations.

With Clients (For Photographers)

If you are a photographer, we share limited information (name, photo, rating) with clients who book your services.

With Photographers (For Clients)

If you are a client, we share property addresses and contact information with assigned photographers to facilitate shoots.

For Legal Reasons

We may disclose information if required by law, legal process, or government request, or to protect our rights, privacy, safety, or property.

Business Transfers

In connection with a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity.

Data Security

We implement appropriate technical and organizational measures to protect your personal information, including:

  • Encryption of data in transit and at rest
  • Secure authentication mechanisms
  • Regular security assessments
  • Employee access controls and training
  • Secure storage of consent records and call recordings with access controls

However, no method of transmission over the Internet is 100% secure. We cannot guarantee absolute security.

Data Retention

We retain your personal information for as long as necessary to fulfill the purposes outlined in this policy, unless a longer retention period is required by law. Specific retention periods include:

  • Account data: Retained while your account is active and for 90 days after closure
  • Consent records: Retained for a minimum of five (5) years from the date of consent or revocation
  • Call recordings: Retained for twelve (12) months unless required longer for legal purposes
  • Call transcripts: Retained for twelve (12) months unless required longer for legal purposes

When you close your account, we will delete or anonymize your information within 90 days, except where retention is necessary for legal or legitimate business purposes (including consent record retention requirements).

Your Rights and Choices

Depending on your location, you may have the following rights:

  • Access: Request a copy of your personal information, including consent records and call recordings
  • Correction: Request correction of inaccurate information
  • Deletion: Request deletion of your personal information (subject to legal retention requirements for consent records)
  • Portability: Request transfer of your data to another service
  • Opt-out: Unsubscribe from marketing communications and/or AI-powered calls
  • Restrict processing: Request limitations on how we use your data
  • Consent withdrawal: Revoke any previously granted consent for AI-powered and automated communications at any time

Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy on our website and updating the "Last updated" date. Your continued use of our services after changes constitutes acceptance of the updated policy. Material changes to how we handle AI communication data or consent records will be communicated via email to affected users.
