Terms of Service

Welcome to LensLooper. These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, completing our training programs, or using our Services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.
2. Eligibility
To use our Services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding agreements
- Not be prohibited from using the Services under applicable law
- Provide accurate and complete registration information
3. Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as needed
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4. Photographer Services
4.1 Certification and Training
Photographers must complete our certification training before accepting jobs through our platform. Training fees are non-refundable once you begin the program. Certification does not guarantee job availability.
4.2 Independent Contractor Status
Photographers using our platform are independent contractors, not employees of LensLooper. You are responsible for:
- Your own taxes and tax filings
- Your own equipment and insurance
- Compliance with all applicable laws and regulations
- Maintaining any required licenses or certifications (e.g., FAA Part 107 for drone operations)
4.3 Service Standards
Photographers agree to:
- Arrive on time for scheduled shoots
- Maintain professional conduct and appearance
- Deliver photos according to our quality standards
- Upload photos within the required timeframe
- Communicate promptly regarding scheduling changes
4.4 Payment Terms
Photographers are paid weekly for completed and approved shoots. Payment amounts are specified at the time of job acceptance. We reserve the right to adjust compensation for quality issues or policy violations.
5. Client Services
5.1 Booking and Scheduling
Clients booking photography services agree to provide accurate property information and ensure access at the scheduled time. Cancellations or rescheduling must be made according to our cancellation policy.
5.2 Payment
Payment is due at the time of booking unless otherwise agreed. All fees are in U.S. dollars. We accept major credit cards and other payment methods as indicated on our platform.
5.3 Deliverables
Edited photos will be delivered within the timeframe specified for your service level. Delivery times begin after the shoot is completed and photos are uploaded by the photographer.
6. Communications and AI-Powered Calls
6.1 Consent to Communications
By creating an account, you consent to receive operational and administrative communications from LensLooper via email, SMS, and phone calls related to your account, appointments, and services. These transactional communications are necessary for the provision of our Services.
6.2 AI-Powered and Automated Calls (Prior Express Written Consent)
LensLooper may use artificial intelligence (AI) and automated telephone dialing systems to make outbound phone calls for purposes including, but not limited to, appointment confirmations, scheduling, reminders, follow-ups, and customer support. During registration or at any time in your account settings, you may provide separate, optional Prior Express Written Consent ("PEWC") to receive AI-powered and automated calls from LensLooper. By providing such consent, you agree to the following:
- You authorize LensLooper, located at www.lenslooper.com, to contact you at the telephone number you provide using AI-generated voice, automated dialing systems, and/or prerecorded voice technology
- You understand and acknowledge that calls may be made by an AI assistant and that the AI nature of the call will be clearly disclosed at the beginning of each call
- Your consent to receive AI-powered and automated calls is entirely voluntary and is NOT a condition of creating an account, purchasing any certification, or using any LensLooper services
- Your consent applies specifically to the phone number you provide during registration or update in your account settings
- Standard carrier message and data rates may apply for calls and messages received
6.3 AI Disclosure
LensLooper is committed to transparency regarding AI usage in communications. All AI-powered outbound calls will include a clear and conspicuous disclosure within the first thirty (30) seconds of the call that:
- The call is being made on behalf of LensLooper
- The caller is an AI assistant, not a human
- The call may be recorded for quality assurance and compliance purposes
You will never be misled about whether you are speaking with a human or an AI system.
6.4 Consent Records
LensLooper maintains detailed records of all communications consents in compliance with the Telephone Consumer Protection Act (TCPA), FCC regulations, and applicable state laws. These records include:
- The date, time, and timestamp (UTC) when consent was granted or revoked
- The method by which consent was provided (e.g., web registration form, account settings update, written agreement)
- The specific telephone number for which consent was provided
- The scope of consent (types of automated and AI-powered calls authorized)
- The IP address and user agent at the time consent was provided (for electronic consent)
- A copy of the consent language presented to the user at the time of consent
Consent records are retained for a minimum of five (5) years from the date of consent or revocation, whichever is later, in compliance with applicable regulations and statutes of limitations.
6.5 Opt-Out and Do Not Call Rights
You may revoke your consent to receive AI-powered and automated calls at any time, free of charge, through any of the following methods:
- Account Settings: Update your communication preferences in your LensLooper account settings at any time
- Phone: Call us at (925) 575-8513 and request removal from AI-powered call lists
- Email: Send a request to support@lenslooper.com with the subject line "Opt Out AI Calls"
- During a Call: Say "stop calling," "remove me," or "opt out" during any AI-powered call to immediately revoke consent
Opt-out requests will be processed and honored within two (2) business days of receipt. LensLooper maintains and honors internal Do Not Call lists and complies with all applicable federal and state Do Not Call regulations, including the National Do Not Call Registry maintained by the Federal Trade Commission (FTC).
Opting out of AI-powered and automated calls will not affect your account status, access to LensLooper services, or ability to purchase certifications. You will continue to receive essential transactional communications (such as password resets and security alerts) as necessary for the operation of your account.
6.6 Call Recording and Monitoring
AI-powered calls may be recorded and monitored for quality assurance, AI training and improvement, compliance verification, and dispute resolution purposes. By consenting to AI-powered calls, you also consent to the recording of those calls in accordance with applicable federal and state recording laws. If you do not wish to be recorded, you may opt out of AI-powered calls using any of the methods described in Section 6.5 above, or you may end the call at any time.
6.7 Scope of AI Communications
By providing your Prior Express Written Consent, you authorize LensLooper to make AI-powered outbound calls for the following purposes, including but not limited to:
- Appointment confirmations, reminders, and scheduling
- Follow-up communications related to completed or upcoming services
- Customer support and service inquiries
- Account-related notifications
- Feedback and quality assurance surveys
- Promotional offers, discounts, and marketing communications about LensLooper services
- New service announcements and certification opportunities
You may opt out of marketing-related AI calls separately from operational calls by updating your communication preferences in your account settings, or by using any of the opt-out methods described in Section 6.5.
7. Intellectual Property
7.1 Our Content
The LensLooper platform, including all content, features, and functionality (excluding User Content), is owned by LensLooper and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our permission.
7.2 Photo Ownership
Photos taken through our platform are owned by LensLooper. Clients receive a license to use photos for real estate marketing purposes. Photographers retain the right to display photos in their portfolio unless otherwise agreed.
7.3 Training Materials
All training materials, courses, and certification content are proprietary to LensLooper. You may not share, redistribute, or commercialize training content.
8. Prohibited Conduct
You agree not to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Harass, abuse, or harm others
- Submit false or misleading information
- Circumvent our platform to work directly with clients or photographers
- Share login credentials or allow unauthorized access
- Interfere with the proper functioning of our Services
- Use automated systems to access our Services without permission
- Engage in any activity that could damage our reputation
9. Termination
We may suspend or terminate your account at any time for violation of these Terms, quality issues, or other reasons at our discretion. You may terminate your account by contacting us. Upon termination:
- Your right to use the Services ceases immediately
- We may retain certain information as required by law
- Provisions that should survive termination will remain in effect
- Your AI call consent records will be retained in accordance with Section 6.4
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:
- Job availability for photographers
- Specific income levels
- Uninterrupted or error-free service
- Results from using our Services
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENSLOOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO LENSLOOPER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless LensLooper, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any rights of third parties.
13. Dispute Resolution
13.1 Informal Resolution
Before filing a formal dispute, you agree to contact us and attempt to resolve the issue informally for at least 30 days.
13.2 Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Los Angeles, California.
13.3 Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class actions or class arbitrations.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting updated Terms on our website and updating the "Last updated" date. Continued use of the Services after changes constitutes acceptance of the modified Terms. Changes to Section 6 (Communications and AI-Powered Calls) that materially alter your consent rights will require your affirmative re-consent before taking effect.
16. General Provisions
- Entire Agreement: These Terms constitute the entire agreement between you and LensLooper regarding the Services.
- Severability: If any provision is found unenforceable, the remaining provisions will continue in effect.
- Waiver: Failure to enforce any provision does not waive our right to enforce it later.
- Assignment: You may not assign these Terms without our consent. We may assign our rights without restriction.
